Terms of Service

These Terms of Service ("Terms") govern your use of Nessie ("Service"). By using the Service, you agree to these Terms.

1. Service Availability

We provide the Service on an "as is" and "as available" basis. While we work to keep Nessie reliable and available, we do not guarantee uninterrupted operation or that every feature will remain unchanged over time.

2. Eligibility and Account Responsibility

You must be at least 18 years old to use the Service. You are responsible for maintaining the security of your account and for all activity associated with it.

3. Your Content and Ownership

You retain all ownership rights in the content you create or input ("Your Content"). We take no ownership of Your Content.

How Your Content is handled depends on the privacy mode you select and whether you enable Cloud Sync. If you enable Cloud Sync, Your Content is stored on our servers for cross-device sync. See our Privacy Policy for details.

4. AI-Generated Content

The Service generates AI-assisted outputs. Nessie does not guarantee the accuracy, legality, or reliability of those outputs. You are responsible for how you use them.

5. Privacy

Your privacy matters. Our Privacy Policy explains what data we collect, the privacy modes available to you, and how we protect your information.

6. Acceptable Use

You agree not to:

  • Use the Service illegally or to harm others
  • Attempt to access systems without authorization
  • Reverse engineer or misuse the Service
  • Upload harmful code or violate intellectual property rights

We may suspend or terminate accounts that violate these rules.

7. Payments

If the Service includes a paid plan:

  • Pricing and features will be disclosed before purchase
  • Fees are non-refundable unless required by law
  • We may update pricing with notice prior to renewal

8. Termination

To delete your account, contact us at founders@nessielabs.com. If you have opted into Cloud Sync, we will delete all associated data from our servers. We may suspend or terminate access if necessary to protect users or the Service.

9. Disclaimers & Limitation of Liability

To the fullest extent allowed by law:

  • We are not liable for damages arising from your use of the Service
  • You use the Service and AI outputs at your own risk
  • We disclaim all warranties, express or implied

10. Changes

If we make material changes, we will notify you. Continued use means you accept the updated Terms.
